Iron Ark Roll-Offs Rental Agreement & Terms and Conditions

By reserving, accepting delivery of, or using a dumpster provided by Iron Ark Roll-Offs (“Iron Ark”), the customer acknowledges and agrees to the following terms and conditions.

1. Rental Period & Pricing

Rental pricing is based on the rental period selected at booking. The rental period begins on the scheduled delivery date and ends on the scheduled pickup date.

The customer is responsible for ensuring the dumpster is ready and accessible for pickup on the scheduled pickup date.

Rental extensions must be requested before the scheduled pickup date and are subject to dumpster availability.

Additional rental days are $42 per day.

A rental extension does not change any other terms of this agreement, including disposal weight limits, prohibited-material requirements, or customer responsibility for the dumpster.

If Iron Ark is unable to retrieve the dumpster because of blocked access, overloading, unsafe conditions, locked gates, customer delay, or another condition attributable to the customer, property, or requested placement, additional daily rental charges may continue until the dumpster can be safely retrieved.

2. $75 Reservation Deposit

A $75 reservation deposit is required at the time of booking to reserve the dumpster and scheduled delivery date.

The reservation deposit will be applied toward the customer’s total rental balance.

The customer remains responsible for the remaining rental balance and any additional charges incurred under this agreement, including:

Excess disposal weight

Additional rental days

Dry-run/trip fees

Dump & Return charges

Prohibited-material charges

Disposal facility surcharges

Equipment damage

Cleanup costs

Other charges resulting from the customer’s use of the dumpster

3. Included Disposal Weight & Overage

Each rental includes the disposal allowance shown for the selected rental package:

3-Day Rental: up to 1.5 ton (3,000 lbs.)

5-Day Rental: up to 1.5 ton (3,000 lbs.)

10-Day Rental: up to 1.5 ton (3,000 lbs.)

Disposal weight exceeding the included allowance will be charged at:

$98 per additional ton, prorated according to actual scale weight.

For example, if the load exceeds the included allowance by one-half ton, the customer will be charged one-half of the applicable per-ton rate.

The customer agrees that disposal facility scale tickets, weight records, or other disposal facility documentation may be used to determine the final disposal weight.

Included disposal allowanaces apply only to standard approved debris and to the original rental disposal unless otherwise specifically stated by Iron Ark.

Certain materials may be subject to different or additional disposal charges. Roofing shingles, concrete, dirt, masonry, tires, appliances, mixed waste, prohibited materials, and other heavy or special-handling materials may be charged according to actual disposal-facility rates, special-handling fees, or other applicable disposal costs.

Iron Ark Roll-Offs reserves the right to assess additional disposal charges when the material type, disposal-facility requirements, government-imposed fees, or disposal costs differ from those included in the standard rental price.

4. Dump & Return Service

If the dumpster becomes full during the original rental period, the customer may request a Dump & Return service, subject to availability.

For a Dump & Return, Iron Ark will retrieve the dumpster, dispose of the contents, and return the dumpster to the rental location.

A $229 Dump & Return service fee applies.

In addition to the $229 service fee, the customer will be charged for the entire actual scale weight of the Dump & Return load at $98 per ton, prorated by actual weight.

The disposal allowance included with the original rental package does not apply to the Dump & Return load.

For example, if a Dump & Return load weighs 2 tons:

$229 service fee + $196 disposal weight charge = $425

A Dump & Return does not extend, reset, or restart the original rental period.

The original scheduled pickup date remains in effect unless additional rental days are purchased at $42 per day and approved by Iron Ark.

Dump & Return service is subject to:

Dumpster availability

Driver and equipment availability

Safe site access

Disposal facility operating hours

Disposal facility acceptance of the material

Applicable transportation and legal weight restrictions

5. Loading Requirements

All materials must remain completely inside the dumpster.

Materials may not extend above the top rails or over the sides of the dumpster.

The dumpster must remain safe and legal for transportation.

The customer may not move, relocate, push, lift, alter, or otherwise tamper with the dumpster after delivery without prior authorization from Iron Ark.

Iron Ark may refuse to transport an overloaded, improperly loaded, overweight, or otherwise unsafe dumpster until the condition has been corrected.

If Iron Ark arrives for pickup and the dumpster cannot be safely transported, a $125 dry-run/trip fee may apply.

The customer is responsible for removing or rearranging material as necessary before another pickup attempt is made.

Additional rental-day charges may continue until the dumpster can be safely retrieved.

6. Prohibited Materials

Unless specifically approved by Iron Ark in advance, prohibited materials include, but are not limited to:

Hazardous or toxic waste

Chemicals

Wet paint

Solvents

Oils

Fuels

Asbestos

Batteries

Medical waste

Propane tanks

Pressurized containers

Explosives

Flammable materials

Radioactive materials

Any material prohibited by law

Any material prohibited by the receiving disposal facility

The customer is responsible for all additional charges resulting from prohibited materials, including:

Special handling charges

Disposal surcharges

Cleanup costs

Transportation costs

Disposal facility penalties

Government fines or penalties

Additional labor

Return-trip charges

Other costs incurred by Iron Ark

Iron Ark reserves the right to refuse transportation of any load containing prohibited or unsafe materials.

7. Special Disposal Items & Facility Surcharges

Certain items may result in additional disposal facility charges even when they are not otherwise prohibited.

These may include, depending on the receiving facility:

Tires

Mattresses

Box springs

Appliances

Refrigerators or equipment containing refrigerants

Electronics

Large furniture

Roofing materials

Certain construction materials

Other items subject to facility-specific surcharges

Any special disposal fee, environmental fee, handling charge, or surcharge assessed by the receiving disposal facility as a result of items contained in the customer’s dumpster may be charged to the customer.

8. Heavy Materials

Concrete, dirt, soil, rock, brick, asphalt, roofing shingles, and other unusually dense or heavy materials require prior approval from Iron Ark.

Iron Ark reserves the right to limit the amount or type of heavy material placed in a dumpster when necessary to comply with:

Dumpster capacity

Trailer capacity

Truck capacity

Roadway weight restrictions

Disposal facility requirements

Applicable laws and regulations

If the dumpster cannot be safely transported because of excessive weight, the customer must remove enough material to allow safe transportation.

If Iron Ark has already arrived for the scheduled service and the load cannot be transported, a $125 dry-run/trip fee will apply.

Additional rental-day charges may continue until the dumpster can be safely retrieved.

9. Dumpster Placement & Property Protection

The customer is responsible for selecting and authorizing the dumpster placement location.

By requesting placement, the customer represents that the requested location is suitable for the weight and operation of the dumpster, truck, trailer, and roll-off equipment.

Iron Ark will use reasonable care during delivery and retrieval and may use protective boards when appropriate.

However, dumpsters, trucks, trailers, and roll-off equipment are extremely heavy.

To the extent permitted by law, Iron Ark is not responsible for damage resulting from normal delivery, placement, use, servicing, or retrieval to:

Concrete

Asphalt

Pavers

Driveways

Curbs

Sidewalks

Lawns

Landscaping

Irrigation systems

Septic systems

Drain fields

Wells

Underground utilities

Pipes

Soft ground

Other surfaces or improvements

when Iron Ark accesses or places equipment at the location authorized by the customer.

The customer must disclose known:

Septic systems

Drain fields

Wells

Irrigation systems

Underground utilities

Soft or unstable ground

Low-clearance areas

Other concealed or hazardous conditions

before delivery.

10. Access for Delivery, Pickup, Exchange & Service

The customer must provide sufficient, safe, and unobstructed access for all scheduled services.

The dumpster and access route must be clear of:

Vehicles

Trailers

Equipment

Locked gates

Low-hanging branches

Wires

Debris

Construction materials

Other obstructions

The customer is responsible for ensuring Iron Ark can safely enter the property, access the dumpster, load the dumpster, and exit the property.

11. $125 Dry-Run / Trip Fee

A $125 dry-run/trip fee applies when Iron Ark arrives for a scheduled delivery, pickup, exchange, Dump & Return, or other requested service but cannot safely complete the service because of a condition attributable to the customer, property, requested placement, or load.

Examples include:

Blocked or insufficient access

Locked gates

Vehicles blocking the dumpster

Equipment blocking the access route

Unsafe site conditions

Customer refusal

Overloaded dumpster

Materials extending above the top rail

Improperly loaded dumpster

Excessive weight

Prohibited materials

Customer-requested placement that cannot be safely accessed

Dumpster not ready for pickup

Other customer or property conditions preventing safe service

If the dumpster cannot be retrieved, additional rental-day charges of $42 per day may continue until the dumpster is accessible and can be safely removed.

The dry-run/trip fee does not apply when Iron Ark cannot complete service solely because of an Iron Ark equipment failure or another circumstance solely within Iron Ark’s control.

12. Permits, HOA Rules & Placement Restrictions

The customer is responsible for determining whether any permit, HOA approval, property-owner authorization, right-of-way authorization, or other permission is required for dumpster placement.

Unless Iron Ark specifically agrees otherwise in writing, the customer is responsible for obtaining all required permissions before delivery.

The customer is responsible for any:

Citation

Fine

Towing expense

Relocation expense

Permit violation

HOA penalty

Other cost

resulting from placement requested by the customer in violation of applicable restrictions.

13. Damage to Iron Ark Equipment

The customer is responsible for damage to Iron Ark equipment caused by misuse or abnormal use while the dumpster is at the customer’s location.

Examples include damage caused by:

Unauthorized relocation

Heavy equipment

Fire

Burning materials

Chemicals

Paint

Prohibited materials

Impact damage

Excessive loading

Intentional damage

Vandalism caused by persons under the customer’s control

Other improper use

Normal wear and tear is excluded.

14. Customer Responsibility for Dumpster & Contents

The customer is responsible for the dumpster and its contents from the time of delivery until retrieval by Iron Ark.

The customer is responsible for informing contractors, employees, tenants, occupants, guests, subcontractors, and other persons using the dumpster of these terms.

Materials placed in the dumpster by third parties remain the responsibility of the customer.

The customer should take reasonable precautions to prevent unauthorized dumping.

15. Cancellation & Rescheduling

Customers should contact Iron Ark as soon as possible to cancel or reschedule a delivery.

Cancellations or rescheduling requests made before dispatch may be handled without a trip fee, subject to Iron Ark’s cancellation policies and any nonrecoverable costs already incurred.

If the truck has already been dispatched or arrives at the service location and the service cannot be completed because of customer cancellation, customer refusal, blocked access, or another customer-related condition, the $125 dry-run/trip fee may apply.

Once the dumpster has been delivered, the rental is considered commenced and rental charges are non-refundable.

Any reservation deposit treatment will be governed by the booking and cancellation terms applicable to the reservation.

16. Additional Charges & Payment Authorization

The customer is responsible for all amounts properly due under this agreement, including:

Original rental charges

Additional rental days at $42 per day

Excess disposal weight at $98 per ton

Dump & Return service fees

Dump & Return disposal weight

The $125 dry-run/trip fee

Prohibited-material charges

Disposal facility surcharges

Special handling charges

Cleanup costs

Equipment damage

Additional labor

Other customer-caused expenses

Where permitted by the customer’s payment authorization and applicable law, amounts properly due under this agreement may be charged to the payment method provided for the rental.

Iron Ark may provide supporting documentation, including disposal facility scale tickets or surcharge records, when applicable.

17. Delays Beyond Iron Ark’s Control

Iron Ark will make reasonable efforts to meet scheduled delivery, pickup, exchange, and Dump & Return times.

Schedules may be affected by circumstances outside Iron Ark’s reasonable control, including:

Weather

Traffic

Road closures

Disposal facility closures

Disposal facility delays

Equipment problems

Mechanical breakdowns

Unsafe conditions

Emergencies

Government restrictions

Other unforeseen circumstances

Iron Ark will make reasonable efforts to communicate significant scheduling changes with the customer.

Iron Ark is not responsible for consequential losses resulting from delays outside its reasonable control.

18. Right to Refuse Unsafe or Unlawful Service

Iron Ark and its drivers reserve the right to refuse delivery, pickup, exchange, Dump & Return, or transportation whenever Iron Ark reasonably determines that performing the service would:

Create an unsafe condition

Risk injury

Risk significant property or equipment damage

Violate applicable law

Violate disposal facility requirements

Exceed truck, trailer, dumpster, or roadway weight limitations

Service may resume once the unsafe or noncompliant condition has been corrected.

19. Electronic Acceptance

By checking the agreement checkbox, submitting a reservation, paying an invoice, accepting delivery, or using the dumpster, the customer acknowledges that they:

Have been provided access to this Rental Agreement & Terms and Conditions

Have had an opportunity to review the agreement

Agree to these terms and applicable charges

Agree to applicable additional charges incurred under this agreement

Consent to conducting the transaction electronically

The customer’s electronic acceptance, payment, acceptance of delivery, or use of Iron Ark equipment is intended to constitute acceptance of these terms.

20. Governing Law

This agreement is governed by the laws of the State of Florida.

Any dispute arising from the rental or use of Iron Ark equipment will be governed by applicable Florida law.
